Usually, the probate lawyer requests a percentage based on the estate’s gross value. For example, some states, such as California, regulate probate lawyer’s fees through the statute.

Probation is a process that consumes a lot of time and effort for a lawyer dealing with a case. In addition, the fees can differ from state to state. The Uniform Probate Code (UPC) is adopted in most states of the US. 

The UPC was established to streamline the probate process. This makes probate administration simpler and less expensive. In addition, the States have utilized this code to standardize the probate process across the states in the US. 

It depends on the area of the estates, which means smaller estates lead to a more straightforward probate process. Generally, in the US, an estate with a property value of less than $100,000 is a smaller estate. Thus, the lawyer dealing with small estates depends on state law. If your estate meets specific requirements, the state may allow you to skip the entire probate process.

Let’s take a case, for example, a probate lawyer dealing with an estate in Texas, a Small Estate Affidavit not including the homestead property or other exempt property and has filed to transfer property to a decedent’s heirs if the value of the estate is less than $75,000.00. 

In California, probate courts allow a decedent to transfer their assets to their heirs and avoid a formal probate proceeding if the total value of their estate is less than $166,250.00 as of January 1, 2020.
